قراءة في نظام انتخاب أعضاء المجالس الشعبية البلدية على ضوء الأمر(01/21) المتضمن القانون العضوي المتعلق بنظام الانتخابات

الملخص
ملخص يعتبر إصلاح النظام الانتخابي مقدمة لأي عملية إصلاحية سياسية، ذلك لمكانته الجوهرية في ضمان الحقوق والحريات الأساسية للأفراد لا سيما صيانة حقي الانتخاب والترشح وكذا تطبيق مبدأ المشاركة. البلديات باعتبارها جماعة محلية قاعدية، وبغية تشكيل مجالسها الشعبية المنتخبة تتمتع بالاستقلال، وتحظى بالشرعية، وتعبر حقيقة عن الإرادة الحرة لمواطنيها، يستوجب ضمان قواعد قانون الانتخاب العدالة والفعلية والجدية. إيجاد نظام انتخاب تمثيلي يعني ضمان عملية انتخابية بلدية نزيهة شفافة، يعالج كل أوجه القصور والاختلالات التي تمس بمصداقيتها وشرعيتها، ويوفر الظروف الملائمة لإجرائها وفق مبادئ المساواة والحياد، الأمر الذي حاول المشرع الانتخابي تحقيقه بإدخال جملة من التحسينات والسعي لترقيته بتحسين شروط التمثيل وتوفير ضمانات وآليات مستحدثة تجسد ذلك. Abstract The reformation of the electoral system is considered the at the heart of any process of political reform, given its place in guaranteeing the basic liberties and rights, particularly the rights to vote, to run for elections, and the implementation of the principle of public participation. The municipalities are the core local governing entities. In order to form their elected popular councils, which function independently, enjoy legitimacy, and manifest the free will of its citizens, the rules of the electoral law should ensure the justice, efficiency, and seriousness of the voting process. The implementation of a representative electoral system is required to ensure a transparent voting process and be able to repair any gaps and threats to its legitimacy as well as proffer the suitable environment for its organisation, based on the principles of equality and neutrality. This is what the Algerian legislator aspires to achieve through the introduction of a number of improvements to the electoral system and the work towards promoting it throughout the advancement of the representation conditions and the establishment of new mechanisms and warranties that ensure this
