كيفيات اختيار للمفوض له وفقا للمرسوم التنفيذي 18-199

الملخص
من أجل حسن اختيار المفوض له لتسيير المرفق العام المحلي أوكل المشرع الجزائري هذه المهمة إلى السلطة المسؤولة عن المرفق العام المحلي وألزمها بإجراء المنافسة والاعلان الذي يسمح بجلب أكبر عدد من المتعاملين المتنافسين ويتحقق حسبه عن طريق صيغة الطلب على المنافسة، أما الاستثناء الوارد عن هذا اختيار ويجيز فيه اهمال هذين الإجراءين يتمثل في صيغة التراضي إذا ما توافرت حالاته المذكورة في المرسوم التنفيذي 18-199المتعلق بتفويض المرفق العام المحلي. وتنشأ السلطة المفوضة لجنة تسمى بلجنة اختيار وانتقاء العروض تكلف باقتراح المترشح في الحالة العادية وفي الحالات الاستثنائية وتؤدي عملها على مراحل لانتقاء أفضل مترشح لاقتراحه على مسؤول السلطة المفوضة لإصدار قرار تفويض المرفق العام المحلي المؤقت الذي يطعن فيه يصبح نهائيا. Abstract : The algerian legislature has entrusted this task to the authority responsible for the local public service. They are obliged to perform competition and advertising, which allows the largest number of competitive clients to be brought in and achieved through the competition demand formula. The exception which allows these two procedures to be neglected, is the form of mutual consent if the cases mentioned in the executive Decree 18/199 are present. The delegated authority shall establish a committee called the Selection of offer’s Committee, which shall be charged with proposing a candidate in the normal and exceptional case. It is undertaking its work in stages to select the best candidate to propose to the official of the authority delegated to issue the provisional local public facility delegation which is rebuttable becomes final. Résumé : Afin d’être bien choisi par le délégataire pour gérer le service public local, le législateur algérien a confié cette tâche à l’autorité responsable du service public local et l’a obligée à mener la concurrence et la déclaration qui permettrait au plus grand nombre de concessionnaires concurrents d’être amenés et réalisés par la formule de la demande de concurrence. L’autorité délégantes établit un comité appelé comité de sélection et de sélection des propositions, chargé de proposer le candidat dans le cas normal et dans des cas exceptionnels, et effectue son travail par étapes pour choisir le meilleur candidat pour sa proposition à l’agent autorisé d’émettre la décision de déléguer l’établissement public local temporaire qui le met au défi de devenir définitif.
