الملخص
تناول هذا البحث أثر التقعيد المقاصدي والأصولي في تخريج نوازل وباء فيروس كورونا المستجد (كوفيد-19)، وذلك من خلال دراسة بعض القواعد المقاصدية والأصولية، والتخريج عليها أحكاما فقهية متعلقة بنازلة وباء كورونا؛ وقد اشتمل البحث على ثلاثة مباحث، اشتمل (المبحث التمهيدي) على مدخل مفاهيمي لمصطلحات البحث، وتناول (المبحث الأول) القواعد المقاصدية ذات الصلة بنوازل وباء كورونا، وخصص (المبحث الثاني) للقواعد الأصولية؛ وخلص البحث إلى إبراز أهمية القواعد الشرعية في التأصيل الشرعي لنوازل وباء كورونا، ودورها الفاعل في ترشيد الاجتهاد الفقهي المعاصر. This study tackled the effect of Sharia’s purposes and Fundamentalist rules on jurisprudence of coronavirus pendamic (covid-19), by explaining some of Sharia’s purposes and Fundamentalist rules and applying them on issues of coronavirus pendamic. The research is divided into three parts: The introductory topic included a conceptual introduction to the search term, the first part dealt with Sharia’s purposes rules, while the second part treated Fundamentalist rules. The research concluded with highlighting the importance of shariaa rules in details for jurisprudence of coronavirus pendamic, and its effective role in Contemporary Jurisprudence rationalization.
