التورق المصرفي المنظم في اطار المعاملات المالية الاسلامية المعاصرة Banking Tawarruq Organized In The Context Of Contemporary Islamic Financial Transactions

الملخص
ملخص: نسعى من خلال هذه الدراسة إلى إبراز حقيقة التورق المصرفي المنظم، ومدى كفاءته في عمليات التمويل التي تقدمها المصارف الإسلامية؛ فقد أدى تطور المجتمعات إلى توسع حاجيات الأفراد ومتطلباتهم التمويلية، مما جعل المنافسة تحتدم بين المصارف الاسلامية والمصارف التقليدية في الاستجابة لهذه المتطلبات والعمل على توفيرها. وقد توصلت الدراسة إلى أن العديد من المؤسسات والمصارف الإسلامية تعمل دون احترام الضوابط والأحكام الشرعية المتعلقة ببعض المعاملات المالية، وكذا الآثار الاقتصادية والاجتماعية السلبية المترتبة عنها، من خلال استحداث وتقديم منتجات وصيغ تمويلية بمسميات إسلامية لكنها ذات طبيعة ربوية؛ قصد المحافظة على ربحيتها وتنافسيتها ومكانتها السوقية أمام المؤسسات والمصارف التقليدية. Abstract: Through this study, we seek to highlight the reality of organized banking tawarruq, and the extent of its efficiency in financing operations provided by Islamic banks. The development of societies has led to an expansion in individuals ’financing needs and requirements, which has made competition intensify between Islamic banks and traditional banks in response to these requirements and work to provide them. The study found that many Islamic institutions and banks operate without respecting the legal controls and provisions related to some financial transactions. In addition to the negative economic and social effects resulting from them by developing and presenting financial products and formulas with Islamic names; but of a usurious nature in order to preserve their profitability, competitiveness, and market position in front of the traditional institutions and banks.
