الشغور الإجرائي في تنفيذ سندات شؤون الأسرة

الملخص
ملخص: يعترض عملية تنفيذ سندات شؤون الأسرة العديد من الإشكالات الناتجة عن الفراغ التشريعي الإجرائي في مجال التنفيذ الأسري، كونه تنفيذ مخصوص يجب فيه مراعاة خصوصية القواعد الموضوعية لقانون الأسرة المتعلقة بأحكام الشرع والنظام العام، مع ضرورة إنشاء قواعد إجرائية أسرية مستقلة عن تلك الواردة في القواعد العامة، تتلاءم مع طبيعة النزاعات الأسريةوتراعي خصوصيتها، حتى يتمّ توحيد الحلول الإجرائية المتّبعة من قبل الجهات القضائية والقائمين بالتنفيذ بشأن تنفيذ سندات شؤون الأسرة، وتتمّ العملية في آجال معقولة بشكل موافق لمقتضيات العدالة، ولا يتمُّ ذلك إلاّ بسدّ الثغرات الإجرائية المشهودة، ثمّ إنشاء قانون إجرائي أسري مستقل وقضاء أسري مستقل يعمل على توحيد الإجراءات المتبعة في تنفيذ سندات شؤون الأسرة وحل الإشكالات التي تعترضها. Abstract: In The process of executing the bonds of familyaffairs faces manyproblemsresultingfrom the legislativeprocedural gap in the field of family law implementation. It is a specific implementation in which the specificity of the substantive rules of family law related to the provisions of Sharia and public order must be taken into account, with the need to establish family procedural rules independent of those contained in the general rules. It is compatible with the nature of family disputes and takes into account their privacy, so that the procedural solutions adopted by the judicial authorities and the implementing agents regarding the implementation of family affairs bonds are unified. Additionally, the process should be carried out in reasonable time in a manner consistent with the requirements of justice. This is only done by filling the witnessed procedural gaps, then establishing an independent family procedural law, and an independent family judiciary working to unify the procedures followed in the implementation of family affairs bonds to solve the problems encountered.
