الملخص
الملخص: إن التعامل مع الوثائق والسجلات الفقهية و القضائية كشكل من أشكال التاريخ أصبح أمرا تفرضه ضرورة البحث التاريخي،وباعتبار الفقه الإسلامي أحد أهم مصادر التاريخ التي حفظت لنا مختلف أنواع المعاملات،فهو بمثابة مادة علمية دسمة توثق لمختلف الأحداث المسجلة ضمن عقود وسجلات للفقهاء والقضاة،والتي ضمَّنوها شروطا تحفظ حقوق الأفراد يرجع إليها في حالة التنازع لاسيما في المعاملات الاجتماعية والاقتصادية منها،فهي تلقي الضوء على دقائق المعاملات الحياتية خاصة وأن مؤلفيها عايشوا تلك الأحداث وكانوا هم القضاة والمفتين فيها.ولعل أهم كتب الوثائق الأندلسية ذات الطابع الفقهي المؤلفة في هذا المجال نجد " كتاب الوثائق والسجلات لابن العطار" الذي ألفه صاحبه خلال القرن الرابع هجري وحاول من خلاله أن يؤرخ لفترة في غاية الأهمية من عمر الدولة الأندلسية ألا وهي فترة الخلافة وبالتالي يعطينا نظرة على طبيعة العقود المبرمة في تلك الفترة،ومعرفة مدى نسبة الزخم في المعاملات آنذاك. تهدف هذه الدراسة إلى إلقاء الضوء على كتاب الوثائق والسجلات لابن العطار،وذلك بالتعرف على مؤلفه وكذا ماهية علم الوثائق،ومحاولة الكشف عن طبيعة المعاملات الاجتماعية والاقتصادية السائدة في المجتمع الأندلسي آنذاك،وبالتالي إدراك مدى قدرة الفقهاء والقضاة على ضبطها،وكذلك إحصاء أهم العقود وتصنيفها حسب مجالات إبرامها. Abstract: Dealing with jurisprudential and judicial documents and records as a form of history has become a matter imposed by the necessity of historical research, as it sheds light on life transactions, especially since their authors lived through those events and were the judges and muftis in them. Perhaps the most important books of Andalusian documents composed in this field are the Book of Documents and Records. Ibn Al-Attar, "in which he tried to date a very important period of the life of the Andalusian state, namely the period of the caliphate, and thus gives us an insight into the nature of the contracts concluded in that period, and to know the extent of the momentum in transactions in that period." This study aims to shed light on the book of documents and records by Ibn al-Attar, by identifying its author as well as what the science of documents is, and trying to uncover the nature of the social and economic transactions prevailing in Andalusian society at the time, and thus realizing the extent of the ability of jurists and judges to control them, as well as counting the most important contracts and classifying them according to Areas of its conclusion
