دور عقد البوت (bot) في تكريس الاستثمار بالطاقات المتجددة

الملخص
ملخص : يهدف هذا البحث إلى دراسة الآليات القانونية التي تحقق مبدأ التعاقد بنظام البوت في مجال الطاقات المتجددة، وذلك بمشاركة القطاع الخاص في تقديم الخدمات العامة في هذا المجال، التي تتمحور في البناء والتشغيل ونقل الملكية، لذا لا بد من دراسة الأطر القانونية التي تحكم التعاقد بنظام BOT، خاصة وأن هذا النوع من العقود له أهمية فعالة للاستثمار في مجالات اقتصادية هامة ومتعددة كمشروعات الطاقة المتجددة، التي تكون من خلال وثيقة تعاقدية تتضمن اتفاقية المشروع . كما أن عقد البوت له دور فعال في تحفيز المستثمرين الأجانب لنقل رؤوس أموالهم للدول المضيفة للاستثمار في الطاقات المتجددة ، مما يكرس التنمية المستدامة في ظل محافظة الدول المضيفة بملكية المشروع بعد نهاية العقد ، بالإضافة إلى الاستفادة من التكنولوجيا المتطورة في مجال البحث واستغلال هذه الطاقات ، ورغم أن هذا العقد محاط بعدة حوافز إلا أنه لا يخلو من العيوب . الكلمات المفتاحية: الطاقة المتجددة ، عقد البوت ، الاستثمار ، اتفاقية المشروع ، القطاع الخاص Abstract: This dissertation intends to investigateon the legal mechanisms and tools of performance-based contracting under BOT system, involving renewable energy projects, where in a private entity supports the delivery of services in accordance with performance standards, centred on construction, operation and transfer of ownership; Therefore, it seems necessary to study the legal frame works governing the BOT system, especially as this type of agreement are so important to invest in different and important economic sectors, as the renewable energy industries , there fore, is the contracts supporting the project and, most importantly, the certainty of the revenue stream set forth in the project agreement. And given the fact that BOT contract is one of the most important methods of foreign investment; It is clear that they have value in attracting foreign and domestic investors in economic development and directing them to the Renewable Energy projects. This kind of contract allows the host countries to operate and maintain these facilities for a certain period; Also, the use of these contracts has access to advanced technology, technical skills and effective methods in the participation in the Renewable Energy investment projects. Although often the BOT method offers manifold advantages, it has inherent drawbacks and critical success factors.
