معالم الدّرس المقاصدي عند ابن راشد القفصيّ دراسة مقاصديّة

الملخص

لا تخفى حظوة الدّرس المقاصديّ عند المعاصرين وحضورها في الدّراسات الشّرعيّة بحثا وتدريسا، تأصيلا وتنزيلا، وذلك بعد البلورة التي آل إليها وفق سيرورة التّدرّج التي تقتضيها العلوم قبل النّضج، أين أفاد من التّراكمية التي خلّفها المتقدّمون من العلماء أصوليّين وفقهاء؛ وقد كان ابن راشد القفصي (ت 736 ه) أحد العلماء الذين أسهموا وألمعوا إلى نكت من فنّ المقاصد، كاعتباره مقصد حفظ الأعراض من الكليّات الضّرورية،وبيانه للمقاصد العامّة من التّشريع، وانتهاجه الدّلالة على المقاصد الجزئية في سائر الأبواب الفقهيّة في تآليفه، فضلا عن البُعد المقاصديّ الحاضر إعمالا وتنزيلا من خلال التّعليل بالمقاصد والمصالح، والبحث محاولة لجمع شتات الموضوع ببيان إسهامات ابن راشد، وكذا التّدليل على ترّسمه المقاصد مدركا من خلال بعض الأصول الاجتهاديّة (سدّ الذّرائع وأصل مراعاة التّهمة) وبعض القواعد الفقهية المقاصديّة مثل قواعد المصالح والمفاسد وقواعد رفع الحرج والتّيسير.
