المسؤولية الإدارية عن الأضرار البيئية

الملخص

تعتبر البيئة كوسط حيوي يعيش فيه الانسان وباقي الكائنات الحية،لهذا نجد أن كل التشريعات الدولية و الوطنية على حد سواء تسهر على تعزيز الحقوق البيئية، لكن التطور التكنولوجي أفرز نتائج وخيمة على عناصر البيئة كالماء و الهواء و التربة، وتسبب في التلوث البيئي الذي أثر على حق الانسان في بيئة نظيفة و سليمة، وأحدث خللا في النظام الايكولوجي ككل، ولهذا فقد تم استحداث نظم قانونية و وسائل وآليات للتعويض عن الأضرار البيئية،والتي تعتبر كضمانات لحماية البيئة من التدهور و بالوقت نفسه تعويضا للمتضررين، خاصة إذا كانت الادارة هي التي ارتكبت الخطأ، لكن الضرر البيئي يتميز بخصوصية كبيرة وعليه تتمثل اشكالية الدراسة في تعريف هذا الضرر ومخاطره و تحديد الأساس القانوني للمسؤولية الادارية البيئية؟ومامدى كفايتها في حماية البيئة؟ ونصل لنتيجة مفادها أن الضرر البيئي ذو طبيعة خاصة يستوجب تحميل الادارة المسؤولية الادارية إما على أساس الخطأ أو الضرر . The environment is a vital medium in which human beings and other living organisms live, so we find all international and national legislation both to promote environmental rights, but technological development has produced serious consequences for elements of the environment such as water, air and soil, and caused environmental pollution that affected the human right to a clean and healthy environment, and disrupted the ecosystem as a whole, and therefore legal systems, means and mechanisms have been developed to compensate for environmental damage, which is considered as safeguards to protect the environment. From degradation and at the same time compensation to those affected, especially if the administration made the mistake, but the environmental damage is characterized by great privacy and therefore the problem of the study is to define this damage and its risks and to determine the legal basis of administrative responsibility for environmental damage? We conclude that environmental damage is of a special nature that requires management to be held administratively responsible either on the basis of error or damage.
