هيئات مكافحة الفساد والوقاية منه في التشريع الجزائري

الملخص
انتشرت جرائم الفساد في الجزائر انتشارا كبيرا وتنوعت أشكالها خاصة في السنوات الأخيرة، على غرار كل دول العالم، وجاءت هذه الورقة البحثية تتناول بالدراسة الجهود المبذولة في الجزائر للوقاية ومكافحة هذه الظاهرة، من خلال التطرق للهيئات والأجهزة المختصة المنشأة لهذا الغرض، وبدراسة تشكيلتها وصلاحياتها وتنظيمها، لنبين مدى فعاليتها وأدائها للدور المنوط بها. فرغم محاولة المشرع الجزائري مسايرة الجهود الدولية لمكافحة الفساد وذلك بإنشاء هيئات مختصة للوقاية منه ومكافحته، ولكن تبين لنا أن هذه الجرائم في تزايد مستمر وتطور أشكالها وطرق ارتكابها بشكل رهيب، وتبقى هذه الهيئات والهياكل تفتقد للفعالية وتقف عاجزة أمام تفشي هذه الظاهرة وانتشارها في كل المؤسسات، لأنها تفتقد للاستقلالية الضرورية لحسن سيرها وأدائها لدورها. Corruption crimes have spread widely in Algeria and varied in its forms especially in recent years, Like all countries of the world, And this research paper came to study the efforts made in Algeria to prevent and combat this phenomenon, By Broaching the competent bodies and Organs established for this purpose, By studying its composition, powers, and organization, To show the extent of its effectiveness and performance of the role assigned to it. Despite the Algerian legislature’s attempt to keep pace with international efforts to combat corruption by establishing specialized bodies to prevent and combat it, But it became clear to us that these crimes are constantly increasing, and their forms and methods of perpetration are evolving terribly, These bodies and structures remain ineffective and stand helpless in the face of the spread of this phenomenon and its spread in all institutions, Because it lacks the independence necessary for its proper functioning and performance of the role assigned to it.
