الملخص
تتكون هذه الدراسة الموسومة ب:" تسامح المسلمين مع أهل الذمة في مجال العلاقات الاجتماعية من خلال بعض النصوص النوازلية بالغرب الإسلامي" من مقدمة وأربعة مباحث: أما المقدمة فقد عرفت فيها بأهم مفردات البحث وهي: التسامح ــ أهل الذمة ــ العلاقات الاجتماعية ــ النوازل. أما المباحث الأربعة فقد خصصتها لإبراز بعض مظاهر تسامح أهل الفقه والفتوى مع أهل الذمة من خلال بعض النصوص النوازلية، وذلك في بعض المجالات الاجتماعية كالإنفاق والتساكن والتجاور والمخالطة في الأسواق وغيرها من المرافق، والزواج والمصاهرة وما يترتب عليهما من الحضانة وغيرها. وحسبي بهذه الخطوة أن أكون قد فتحت أمام الباحثين مجالا جديدا للبحث في المكتبة النوازلية المال كية بالغرب الإسلامي، والتي ظلت أغلب البحوث فيها منحصرة في القضايا التي تعنى بالمسلمين في علاقاتهم مع بعضهم البعض، في حين أن الباحث في ثنايا تلك المصادر يقف على مادة نوازلية غزيرة تصلح لاعتمادها كقاعدة ومنطلقا في دحض شبه كثيرة عن الإسلام والمسلمين، خاصة ما يتعلق منها بقضايا الاستبداد والتعصب ضد غير المسلمين. This research paper, entitled "Tolerance of Muslims toward the Community of non-Muslim subjects in the field of social relationships through some jurisprudential texts in the Islamic Maghreb," is made up of an introduction and four research chapters: Regarding the introduction, I defined the main research terms; namely, tolerance, the community of non-Muslim subjects, social relationships, and jurisprudence. With respect to the four research chapters, they revolve around some aspects of tolerance showed by the scholars of jurisprudence toward the community of non-Muslim subjects using some jurisprudential texts in some social fields like expenditure, cohabitation, neighborhood, association in markets and facilities, marriage, child custody, etc. My intent is to open a new sphere of research for researchers to examine the Malki jurisprudential heritage in the Islamic Maghreb, because most of the researches undertaken in this regard have been restricted to issues concerning inter-Muslim relationships. However, upon examining such sources, one can find abundant jurisprudential materials that can serve as a basis to refute several stigmas on Islam and Muslims, notably the issues relating to tyranny and extremism against non-Muslims.
