الملخص
تهدف الدراسة إلى الكشف عن الأساليب البرهانية و الحجاجية، في الخطاب القانوني التي يعتمدها المحامي في الإقناع، حيث تختلف درجات الإقناع باختلاف الخطاب الموجه؛ من حيث التأثير والقصدية. ومن ثمة كيفية مساهمة هذه الأساليب البرهانية في تغيير حال المتهم من قفص الاتهام إلى فعل البراءة تحقق شرط الإقناع لنجاح المرافعة، وهل للروابط الحجاجية دور في تحقيق قصدية المحامي. ولأن الأسلوب اللغة، فسعيا مني لتقصي الأساليب التي يعتمدها المحامي في الإقناع، تم عرض نماذج من مرافعة شفوية وتحليلها. الكلمات المفتاح : برهان- خطاب- مرافعة-إقناع-محامي. Abstract : The study aims to uncover the evidentiary and argumentative methods in the legal discourse adopted by the lawyer in persuasion, where the degrees of persuasion differ according to the discourse directed. In terms of impact and intentionality. From there, how can these evidentiary methods contribute to changing the condition of the accused from the dock to the act of innocence, which fulfills the requirement of persuasion for the success of the pleading, and do the arguments links have a role in achieving the intention of the lawyer? And because the method is the language, so in my endeavor to investigate the methods used by the lawyer in persuasion, samples of oral argument were presented and analyzed.
