التنظيم القانوني لصورة سند السحب والإشكاليات المترتبة إبّانها

الملخص
اتجهت الدراسة إلى تعريف الصورة لسند السحب, في ظل غياب التعريف القانوني لها كما وتبيان ماهية نشأت الصور لسند السحب, كما وتقييم مزايا الصورة لسند السحب والتي يمكن تلخيصها بتحقيقها لمبدأ السرعة في التعاملات التجارية وتحقيق الأمان الإحتياطي من سرقة السند الرسمي أو ضياعه, كما وتم ذكر سلبيات الصوة لسند السحب والتي تكاد أن لا تكون متوفرة إذا ما لم تستخدم الصورة لأغراض الغش, كما وتطرق الباحث إلى تبيان الأحكام القانونية التي كان قد رتبها المشرع لصورة سند السحب وفقاً لنصوص قانون التجارة الأردني, وما لخص له الباحث بإن لصورة السند الأحكام ذاتها للسند الأصلي, من حماية قانونية وإمكانيتها للتداول أو إستخدامها لأغراض التظهير أو لأغراض الضمان التوكيلي أو التأميني. The study went on to define the image of the withdrawal bond, in the absence of a legal definition of it as well as to show what the images originated for the withdrawal bond, as well as to evaluate the advantages of the image of the withdrawal bond, which can be summarized by achieving the principle of speed in business dealings and achieving precautionary security from the theft or loss of the official bond, as mentioned the negatives of the sound of the withdrawal bond, which are almost not available if the image is not used for fraud purposes. The researcher also discussed the statement of the legal provisions that the legislator had arranged for the image of the withdrawal bond in accordance with the provisions of the Jordanian Trade Law, and what the researcher summarized to him that the image of the bond has the same provisions of the original bond, of legal protection and its possibility to trade or use it for the purposes of endorsement or for the purposes of proxy or insurance guarantee.
