نظرية الظروف الطارئة وتطبيقاتها في العقود الدولية

الملخص
الأصل في العقود أنها تتمتع بالقوة الإلزامية، إذ لا يمكن تعديلها أو نقضها وفقا لمبدأ العقد شريعة المتعاقدين، إلا أنه توجد حالات استثنائية يمكن الخروج فيها عن القاعدة العامة إذ يتم فيها تعديل العقد بالإرادة الاتفاقية للأطراف متى استدعت الضرورة لذلك، وهو ما يسمى بنظرية الظروف الطارئة التي تطبق من أجل إعادة التوازن الاقتصادي بين الالتزامات المتقابلة منها في أحد مراحل تنفيذ العقد. يظهر الهدف من هذه الدراسة في إبراز أهمية نظرية الظروف الطارئة وإبراز الفائدة العلمية والعملية لتطبيقها خاصة في العقود الدولية التي عادة ما تكون طويلة المدى في تنفيذها. The principle in contracts is that they have binding power, as they cannot be modified or revoked according to the principle of the contract, the Shari'a of the contractors, but there are exceptional cases in which it is possible to deviate from the general rule in which the contract is amended by the agreement of the parties when necessary, and this is called the theory of contingencies. That are applied in order to restore the economic balance between the corresponding obligations thereof in one of the contract implementation stages . The aim of this study appears to highlight the importance of the theory of contingencies and the scientific and practical benefit of its application, especially in international contracts that are long-term in their implementation.
