غموض الركن المادي في جرائم الأعمال

الملخص
يهدف البحث إلى إبراز مظاهر انقلاب خصوصية الركن المادي في جرائم الأعمال عن القواعد التقليدية في القانون الجنائي العام، حيث ترتب على ظاهرة التفويض التشريعي غموض في صياغة نصوص جرائم الأعمال في إطار النصوص التنظيمية، والذي أدى إلى عدم احترام الدقة في الصياغة من جهة، وفتح المجال للقاضي لمعرفة صور الركن المادي في هذا النوع من الجرائم لسد الثغرات الموجودة في القانون. زيادة على ذلك، إذا كانت الدراسة السطحية في جرائم الأعمال توحي للوهلة الأولى أنها لا تخرج عن القواعد العامة حيث تتطلب فعل إجرامي، نتيجة محظورة وعلاقة سببية، لكن بعد التمعن يلاحظ خروجها عن القواعد العامة من حيث خصوصية الوقائع المشكلة لهذا الركن سواء من حيث السلوك الإجرامي الذي يأخذ طابع فني تقني هذا من جهة، ومن جهة أخرى منح مكانة لجرائم الخطر بتخلف عنصر النتيجة في جرائم الأعمال. Moreover, if the superficial study of business crimes suggests at first glance that it does not fall outside the general rules where a criminal offence is required where it requires a criminal act, a forbidden consequence and a causal relationship, but , after take closer look , it is noticed that it deviates from the general rules in terms of the specificity of the facts forming this element whether in terms of criminal behaviour that takes on this technical nature on the one hand, On the other hand, granting status to dangerous crimes By lagging the result element in business crimes
