المسؤولية الجنائية للأحداث في التشريع الجزائري

الملخص
إن الجريمة في العصر الحالي أصبحت متفشية بشكل فظيع مما يبعث القلق في نفوس الأشخاص، فلم تعد الجرائم قليلة كما في الماضي، بل ازدادت توسعا وانتشارا وتنوعا والإجرام لا يتأتى بين ليلة وضحاها، وإنّما هو نتيجة تراكمات بعيدة المدى، أي أنّها تنطلق من النواة الأولى أي مرحلة الطفولة حتى الشباب، فبعد أن كان الحدث هو الضحية، أصبح هو الجاني، وعلى أساس أن مرحلة الحدثة تعد من أهم المراحل، وتشكل منعطف خطير في حياة الفرد وتؤثر على حياته وسلوكه الاجتماعي والنفسي على حد السواء، وجب على الأسرة بالدرجة الأولى ، ومختلف الفاعلين في المجتمع مع الحدث التبصر له دون إفراط أو تفريط ، وأصبحت أهم مشكلة يعانيه الحدث هو شعوره بالتبعية ومحاولته التحرر من المراقبة المستمرة لسلوكاته، وذلك من خلال معارضته ما يقال له وبحثه عن بيئة أخرى غير أسرته مما يجعله قد يصادف بيئات فاسدة تعلمه سلوكات منحرفة تدخله في عالم الجريمة المحظورة، وقد خصص المشرع الجزائري هذا الحدث ببعض الأحكام في حالة قيام مسؤوليته الجزائية ميزه بذلك عن الشخص البالغ، لذا فإنني أهدف من خلال هذا البحث إلى معرفة ما إذا كان المشرع الجزائري أحسن تنظيم المسؤولية الجزائية للأحداث. Abstract : Crime in the current era has become terribly rampant, which causes concern to people. Crimes are no longer as few as in the past, but have expanded and spread and diversified and crime does not come overnight, but rather is the result of long-term accumulations, that is, it starts from the first nucleus, i.e. Childhood stage until youth, after the event was the victim, he became the culprit, and on the basis that the juvenile stage is one of the most important stages, and constitutes a dangerous turning point in the life of an individual and affects both his life and his social and psychological behavior, it is the duty of the family in the first place, and the various actors In society with the event, the insight into him without excessive or negligence, and the most important problem that the juvenile suffers from is his feeling of dependence and his attempt to be free from constant observation of his behavior, through his opposition to what he is told and his search for an environment other than his family, which makes him encounter corrupt environments that teach him deviant behaviors that interfere with him. The world of the banned crime, and the Algerian legislator has allocated this event with some provisions in the event of his criminal responsibility, which distinguished him from the adult person, so I aim through this research to find out whether the Algerian legislator has better regulation of responsibility Juvenile penalties.
