الملخص
إن الدفع بانعدام وجود اتفاق التحكيم شأن الدفع بعدم الاختصاص من الدفوع المقررة الذي أكدت عليه أغلب الاتفاقيات الدولية المنظمة للتحكيم التجاري الدولي و بالأخص اتفاقية واشنطن سنة 1965 ، و أنه بفضل التوجه الدولي أمكن الاعتراف بها لهيئة التحكيم عند نظر النزاع أمامها ، الأمر الذي يعني جواز التمسك به أصالة أمام القضاء في حالة الدفع من قبل الطرف الأخر . بمعنى أن الالتجاء للتحكيم و تشكيل هيئة التحكيم لا يتم دفعه بالتجاء الشخص للقضاء بدعوى عدم الاعتداد باتفاق التحكيم و انعدامه ، بل يكون الطريق الصحيح في هذه الحالة التمسك بانعدام وجود اتفاق التحكيم أمام هيئة التحكيم حتى يتم تفعيل إجراءات الأمان التشريعي لجميع الأطراف . الكلمات المفتاحية : اتفاق التحكيم ؛ هيئة التحكيم ؛ فاعلية ؛ الدولي ؛ الحكم التحكيمي . Abstract: Advocating the absence of an arbitration agreement, like submitting a lack of jurisdiction, is one of the established defenses confirmed by most international agreements governing international commercial arbitration, especially the Washington Agreement in 1965, and that thanks to the international approach it was possible to recognize it to the arbitration board when looking at the dispute before it, which means that it is permissible to adhere It has authenticity before the court in case of payment by the other party. In the sense that resorting to arbitration and the formation of the arbitration board is not pushed by the person resorting to the court on the pretext of not observing the arbitration agreement and its absence, but the right way in this case is to adhere to the absence of an arbitration agreement in front of the arbitration board until the legislative safety procedures for all parties are activated. key words: : Arbitration convection, arbitral tribunal, effectiveness, international, arbitral award.
