الملخص
تعتبر التجربة الجزائرية فيما يخص سلطات الضبط أو السلطات الإدارية المستقلة تجربة حديثة مقارنة بالنماذج الرائدة في هذا المجال كالنموذج الأمريكي، الإنجليزي والنموذج الفرنسي وذلك ناتج لحداثة الدولة الجزائرية وطول مسار بناء الدولة وهياكلها الإدارية و أيضا بسبب النهج المتبع قبل دستور 1989 وتبني النظام الاشتراكي في شتى المجالات الاجتماعية، الاقتصادية والسياسية ، ومع إقرار دستور 1989 الانفتاح في مختلف المجالات يكون قد فتح الباب لإنشاء مثل هذه السلطات، وهو ما عززه دستور 1996 بإقراره لمبدأي حياد الإدارة وحريات الصناعة والتجارة، ولقد عمد المشرع الجزائري إلى إنشاء عدد معتبر من هذه السلطات، حيث يمكن التمييز بين مرحلتين، مرحلة دستور 1989 وكانت فيها أول تجربة مع المجلس الأعلى للإعلام، والمرحلة الثانية في ظل دستور 1996 حيث شهدت تسارعا في إنشاء وتطور السلطات الإدارية المستقلة. Abstract: Thé Algerian expérience with regard to Control authorities or independent administrative authorities is a recent experience compared to the leading models in this field, such as the American model, the English model and the French model, and this is a result of the modernity of the Algerian state and the length of the state building path and its administrative structures, and also because of the approach taken before the 1989 constitution and the adoption of the socialist system in various areas Social, economic and political, and with the approval of the 1989 constitution, openness in various fields would have opened the door for the establishment of such powers, which was reinforced by the 1996 constitution by adopting the principles of neutrality of administration and freedoms of industry and trade. The legislator baptized Algeria To create a considerable number of these authorities, where they can distinguish between the two phases, the stage of the 1989 Constitution and was the first experience with the Higher Media Council, the second stage under the 1996 Constitution, which saw an acceleration in the establishment and development of independent administrative authorities.
