Abstract
abstract: This article aims to clarify the foundations of modern international responsibility resulting from pollution of the environment with radioactive materials as constituting environmental damage, regardless of adherence to the established basis for this responsibility, given that the environment and its protection are the cornerstone of human rights that must be protected in accordance with the modern international plan, without political, ideological, or geographical considerations. It should also be taken into consideration the set of obligations that result from radioactive pollution of the environment, where the party is responsible in front of many solutions, either by correcting the act committed to restore the situation to what it was or saving the environment as it leads to accepting new international mechanisms that reduce, and put an end to the violations that The environment is experiencing pollution from radioactive materials. ملخص : يهدف هذا المقال إلى توضيح أسس المسؤولية الدولية الحديثة الناتجة عن تلوث البيئة بالمواد المشعة باعتبارها أضرارًا بيئية ، بصرف النظر عن الالتزام بالأساس الثابت لهذه المسؤولية ، نظرًا لأن البيئة وحمايتها هما حجر الزاوية لحقوق الإنسان التي يجب حمايتها وفقًا للخطة الدولية الحديثة ، و التي تتحد معظم الدول لتحقيقها دون اعتبارات سياسية أو أيديولوجية أو جغرافية. كما يجب أيضًا أن تؤخذ في الاعتبار مجموعة الالتزامات الناتجة عن التلوث الإشعاعي للبيئة ، حيث يكون الطرف مسئولا أمام العديد من الحلول ، إما بتصحيح الفعل الملتزم بإعادة الحالة إلى ما كانت عليه أو إنقاذ البيئة على النحو الذي يؤدي إلى قبول آليات دولية جديدة تقلل ، وتضع حدًا للانتهاكات التي تتعرض لها البيئة من المواد المشعة.
