مشروعية استخدام القوة في ظل مبدا مسؤولية الحماية

الملخص
مـلخـص: يتناول هذا الموضوع مشروعية استخدام القوة في ظل مبدأ مسؤولية الحماية بعد إذن من مجلس الأمن وبقرار بموجب الفصل السابع. الذي يعد كملاذ أخير واحد أهم الوسائل المتخذة من قبل المجتمع الدولي لتنفيذ مبدأ مسؤولية الحماية بهدف الحد من الانتهاكات المرتكبة في حق الضحايا أثناء النزاعات المسلحة، وذلك بعد استنفاذ كل الطرق الوقائية التي جاء بها قرار الجمعية العامة للأمم المتحدة لمؤتمر القمة العالمي (2005) المتمثلة في التدابير السياسية والاقتصادية والأمنية. ولعلى أهم ما يثار أيضا في هذه دراسة، الجوانب الإنسانية التي يشترط مراعاتها أثناء سير العمليات العدائية لتنفيذ مبدأ مسؤولية الحماية، مثل مبدأ عدم حرية أطراف النزاع في اختيار وسائل وأساليب القتال للإضرار بالعدو، ومبدأ التمييز بين المقاتلين وغير المقاتلين والأعيان المدنية والأهداف العسكرية، ومبدأ الضرورة العسكرية، ومبدأ التناسب. مـلخـص: يتناول هذا الموضوع مشروعية استخدام القوة في ظل مبدأ مسؤولية الحماية بعد إذن من مجلس الأمن وبقرار بموجب الفصل السابع. الذي يعد كملاذ أخير واحد أهم الوسائل المتخذة من قبل المجتمع الدولي لتنفيذ مبدأ مسؤولية الحماية بهدف الحد من الانتهاكات المرتكبة في حق الضحايا أثناء النزاعات المسلحة، وذلك بعد استنفاذ كل الطرق الوقائية التي جاء بها قرار الجمعية العامة للأمم المتحدة لمؤتمر القمة العالمي (2005) المتمثلة في التدابير السياسية والاقتصادية والأمنية. ولعلى أهم ما يثار أيضا في هذه دراسة، الجوانب الإنسانية التي يشترط مراعاتها أثناء سير العمليات العدائية لتنفيذ مبدأ مسؤولية الحماية، مثل مبدأ عدم حرية أطراف النزاع في اختيار وسائل وأساليب القتال للإضرار بالعدو، ومبدأ التمييز بين المقاتلين وغير المقاتلين والأعيان المدنية والأهداف العسكرية، ومبدأ الضرورة العسكرية، ومبدأ التناسب. الكلمات المفتاحية: مبدأ مسؤولية الحماية؛ استخدام القوة؛ القانون الدولي الإنساني؛ الأمم المتحدة. Abstract: This topic deals with the legality of the use of armed force under the principle of the responsibility to protect authorized by the Security Concil under chapter (VII) which is considered as the last resort, and one of the most important means taken by the international community in order to reduce violations committed against victims during armed conflicts, after axhausting all the preventive methods that endorssed by the General Assembly in the word summit (2005) represented in political, economic, and security measures. The most important thing that is also raised in this study is the humanitarian aspects concerns to protect during the conflicts, and the violations considered as keys to implement the principle of the responsibility to protect, along with other principles, such as the principole that parties to conflict are not free to choose the means and methods if fighting in order to harm the enemy, the principle of distinction between combatants and non-combatants, civilian objectives, and military objectives, and the principle of necessity Military, and the principle of proportionality Keywords: The principle of the responsibility to protect; the use of force; international humanitarian law; the United Nations.
