أسس صناعة النظرية الفقهية

الملخص
تهدف هذه الدراسة إلى بيان كيفية صناعة النظرية الفقهية، من خلال: إيضاح أسس بنائها، ومنهجية بناء تلك الأسس لإنشاء نظرية فقهية جديدة، وفق أصول البحث العلمي. وانتهى البحث إلى أن للنظرية الفقهية أسساً قامت عليها، ويمكن بناء تلك الأسس لصناعة نظرية فقهية جديدة. الكلمات المفتاحية: أسس النظرية الفقهية، صناعة النظرية الفقهية. This study aims to demonstrate how the jurisprudence theory is made, by: clarifying the foundations of its construction, and the methodology of building those foundations to create a new jurisprudence theory, according to the principles of scientific research. The research concluded that the doctrinal theory has foundations on which to base it, and those foundations can be built to create a new doctrinal theory.
