الملخص
أولت القوانين والاتفاقيات الدولية حماية قانونية للأجانب المقيمين في أقاليم دول أجنبية بصفة غير نظامية، ورغم تجريم التشريعات لظاهرة الهجرة غير الشرعية أو مخالفة القوانين والأنظمة المتعلقة بمغادرة التراب الوطني، وكذا جريمة تهريب المهاجرين، إلا أنه من ناحية أخرى ينبغي تقديم حماية إلى الأجنبي المقيم بطريقة غير نظامية، بدءا بالتعامل الإنساني مع الأجنبي وذويه وتقديم المساعدة اللازمة للمحتجزين وطالبي اللجوء السياسي، ومن هنا يمكن طرح التساؤل التالي: ما هي أهم الضمانات المقرّرة للأجنبي في ظل تجريم سلوك الإقامة غير المشروعة في القانون الجزائري ؟ Abstract: The laws granted to international conventions the legal protection of foreigners residing irregularly in the territory of foreign countries, despite the criminalization of the legislation relating to the phenomenon of illegal immigration or the circumvention of laws and regulations related to the exit from the national territory, thus that the crime of smuggling of migrants, and on the other hand the resident must be protected irregularly, starting with humane treatment With the foreigner and his family. We can therefore ask the following question: What are the most important guarantees established for a foreigner with regard to the criminalization of illegal resident behavior under Algerian law?
