معاملة المذنبين بين قانون السجون الجزائري والقواعد النموذجية الدنيا لمعاملة السجناء

الملخص
يهدف هذا البحث الى عرض أهم نقاط التقاطع بين قانون تنظيم السجون وإعادة الادماج الاجتماعي للمحبوسين الجزائري والقواعد النموذجية الدنيا لمعاملة السجناء التي اعتمدتها الأمم المتحدة كمعيار في التعامل مع السجناء في ظل السياسة الجنائية المعاصرة في مواجهة الجريمة وحماية الفرد والمجتمع، وذلك من خلال اتخاذ جملة من التدابير والإجراءات التي تحقق العقاب من جهة، وتؤكد على مبدأ الإصلاح والعلاج، وإعادة ادماج المذنب الى المحيط الاجتماعي كفرد سليم، وقادر على تحمل مسؤولياته الاجتماعية، ومن بين الأمور التي تم عرضها في البحث جملة حقوق المسجون، كالحق في المعاملة الإنسانية، الحق في التكفل الاجتماعي، التكفل النفسي، التكفل الصحي، الحق في التعليم والتكوين، الحق في الترفيه والترويح، وهي جملة النقاط المثارة في البحث وتناولها من وجهة نظر قانون السجون الجزائري ومقارنته بالقواعد النموذجية الدنيا لمعاملة السجناء. القانون، السجن، العقاب، المعاملة، المذنب. *** Abstract: This research aims to present the most important points of intersection between the Law on the Organization of Prisons and the social reintegration of Algerian prisoners and the minimum model rules for the treatment of prisoners adopted by the United Nations as a standard in dealing with prisoners under the contemporary criminal policy in the face of crime and the protection of the individual and society, through the adoption of a number of measures and measures that achieve punishment on the one hand, and emphasize the principle of reform and treatment, and the reintegration of the offender into the social environment as a healthy individual, able to assume his social responsibilities, among other things presented in the Research on the rights of prisoners, such as the right to human treatment, the right to social welfare, psychological care, health care, the right to education and training, the right to recreation and recreation, which are among the points raised in the research and addressed from the point of view of the Algerian prison law and compare it with the minimum model rules for the treatment of prisoners.
