الملخص
يُعتبر الإستغلال غير المشروع من أخطر صور الجرائم الماسة بسلامة المعطيات الشخصية خاصة في ظل التطور العلمي و بروز ما يعرف بالعالم الإفتراضي أو البيئة الرقمية، لذا كان لابد من توفير حماية جزائية لها من هذا الاعتداء، و عليه سنحاول من خلال هذه الورقة البحثية تسليط الضوء على صور الجرائم المتعلقة بالإستغلال غير المشروع للمعطيات الشخصية من منظور القانون رقم: 18-07 المؤرخ في: 10 يونيو 2018 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي، و مدى كفاية و فعالية هذه النصوص في توفير هذه الحماية. Illegal exploitation is considered one of the most dangerous forms of crimes affecting the integrity of personal data, especially in light of scientific development and the emergence of what is known as the virtual world or digital environment, so it was necessary to provide a penal protection for it from this abuse, and therefore we will try through this research paper to shed light on Pictures of crimes related to the unlawful exploitation of personal data from the perspective of Law No. 18-07 dated: June 10, 2018 relating to the protection of natural persons in the field of data processing of a personal nature, and the adequacy and effectiveness of these texts in providing this protection.
