دستور قرطاج ومؤسساتها خلال المرحلة الأرستقراطية (480- 237 ق.م)

الملخص
لم يكن اختيارنا لموضوع -دستور قرطاج ومؤسساتها خلال المرحلة الأرستقراطية- محض صدفة بل جاء نتيجة لما وقفنا عليه أثناء انجازنا -لرسالة الدكتوراه-، فقد توصلنا أثناء العمل إلى نتيجة مفادها، أن الدارس والمتأمل في التاريخ السياسي للدولة القرطاجية، والذي شهد تطورا من -الملكية إلى الأرستقراطية إلى الديمقراطية-، يلحظ بوضوح ظاهرة بروز دستور قرطاج ومؤسساتها خلال الحقبة الأرستقراطية، حتى أنه لا يبالغ إذا صرح إلى كونها تمثل أهم مرحلة من مراحل تاريخ قرطاج السياسي، ولئن كانت أغلب الدراسات عند الإشارة إلى – الفترة محل الدراسة- تركز على الجانب العسكري متجاهلة في أغلب الأحيان خصائص ومميزات المنظومة السياسية، لذلك فإن الهدف من هذه الدراسة يكمن في السعي والوقوف على الدستور القرطاجي، الذي حظي باهتمام الفيلسوف الإغريقي أرسطو طاليس وشهادته بأنه أرقى دساتير العالم أنذاك معدد مزاياه، وكذلك التعريج على الهيئات الحاكمة، والتي كان على رأسها السبطان اللذان اختصا بتسيير شؤون الدولة لمدة عام بالتعاون مع مجلس الشيوخ، يضاف إلى ذلك محكمة المائة والأربعة ومجلس الشعب، كما ونهدف إلى تبين العوامل المؤثرة في الدستور، وإبراز الدور الذي أدته كل مؤسسة في تاريخ الدولة القرطاجية. It is not by coincidence that we choose the theme; Carthage constitution and institutions during the Aristocratic era. But it is a result to what we see during our work on the PH D thesis. So we get reach a result that the searcher and the observer of the political history of the state of Carthage, which evolved from the Monarchy to the Aristocracy to the Democracy , can observe clearly the appearance of constitution and the institutions of Carthage during the Aristocratic era. It can't be a sort of exaggeration if the observer states that this era is the most important one among those periods of the Carthaginian political history. Despite the fact that the majority of researches, in relation to the era under consideration, concentrated on the military sector and usually ignore the characteristics and specifications of the political system. So the aim of this study is to know about the Carthaginian constitution that had take the attention of the Greek philosopher ARISTOTLE and his famous confirmation that "this constitution is the most sophisticated in the world" at that time and he counted its privileges. In addition the counting of the governing committee which was headed by the two grand sons who were specialized to govern the state affairs for one year in collaboration with the Senate added to the court of one hundred and four, and the people's house. Also we will demonstrate the factors that impressed the constitution and display the role played by each institution during the history of the state of Carthage.
