الملخص
الملخص لقد أدركت الدول أهمية البرمجيات والمعلوماتية في الحياة المعاصرة ،باعتبارها موردا بالغ الأهمية اقتصاديا، هذا التطور الذي نتج عنه نمط جديد في المعاملات ، وكذا التبادلات التجارية تتم عبر وسيط إلكتروني ، وفي عالم افتراضي لا يعترف بالحدود الجغرافية ، وقد اصطلح على تسميته "بالتجارة الإلكترونية " والتي أصبحت واقعا ملموسا في كل أنحاء العالم،وما بروز شركات عملاقة مثل amazon - Alibaba إلا خير دليل على ذلك ،وقد أسال هذا الكثير من الحبر من قبل المفكرين، ورجال الأعمال والمشرعين ، ولا تزال النقاشات والدراسات مفتوحة على مصراعيها بشأنها،على مستوى الهيئات والمنظمات الإقليمية والعالمية ، وباعتبار أن الجزائر جزء من هذا العالم المتسارع والمتطور ، فقد سنت العديد من القوانين التي تنظم عمل العقد الإلكتروني ، وإن كانت تسير بخطا بطيئة للحاق بركب الدول المتطورة في هذا المجال . The States have realised the importenceof software and informatics in contemporary life as a matter of economic importence this development has resulted in a new pattern of transactions as well astrade exchanges through an electronic medium and in a virtual world that does not recognize the geographical boundaries and has been referred to as. Commerce which has become a reality in every aspect of the world The giant companies such as amazon and alibaba are the only ones to do so this may be asked by many intellectuals businessmen and legislators and discussions are still on going and studies are far- reaching at the Level of bodies and organizations regional and global levels and consideringalgeria.as a Part of this fast and evolving world many laws have beene enacted which regulates the work of the electronic contract though it is going slowly to catch up developed countries in this field .RESUME/ l’ensemble des pays ont compris que l’informatique et la programation joue un role essentel et primordial dans la vie contenporaine cette nouvelle science se considère comme une ressource esctrèmemelent importente notament sure le plan économique ce nouveau progrés a contribué à la naissance d’un nouveau système dans les échanges commerciausc s’ffectuent par le biais d’un médiateur électronique dans un monde virtuel transgressant tous les obstacles et les frantières jéographiques connue dans le non de commerce électronique cette activité commerciale est devenue une réalité vécue à travers les quatre points cardinausc l’apparitions et l’épanorrissement des compagnies géants telle que (Amazone-Alibaba) servent de bons escemple illustrant cela dans cette perspective ce nouveau mode d’échange a fait couler beaucoup d’encre pare de nombreusc penseurs hommes d’affaires et législatteurs cette problématique de nos jours un vif débat et oblige les spécialistes à mener des étuds sérieuses pour bien cerner ce sujet sur le plan national l’algerie apris conscience de cet enjèn pour ce fait elle a décidé de relevé ce défi en décrétant des lois organisant le travail du contrat électronique malgré les difficultés rencontrés et ce pour etre au première rang des pays développés dans ce domaine .
