الإجراءات الجزائية في القرآن الكريم - دراسة تأصيلية

الملخص
يهدف البحث إلى تأصيل الإجراءات الجزائية في القرآن الكريم، وكيف فهم العلماء دلالة الآيات على هذه الإجراءات، وقد تبين من خلال البحث أن الآيات الآمرة بالعدالة تعد من أهم الأصول لكثير من الإجراءات، وغير ذلك من الآيات التي أكّدت ضرورة التثبت قبل الحكم من قبل القضاة والمحققين، وأقرت إجراءات التحقيق ومستلزماته، مثل: كتابة المحاضر واعتماد الخبرة والتفتيش الجنائي، وأشارت إلى ضرورة تصنيف المتهمين، وحبسهم، وجواز الحيلة للوصول إلى الحقيقة، ووضعت ضوابط للإثبات، مثل: مشروعية الدليل وقطعيته، وحمّلت المدعي عبء الإثبات، وأقرت وظيفة النيابة العامة، ومن ثم فصّلت بعض إجراءات الشهادة فأصّلت مداركها وبعض شروطها، وأقرت تحليف الشاهد، ثم أسست للاعتماد على قرائن الأحوال وما يتبعها من علم القاضي وفطنته. بما يؤكد اهتمام القرآن بالإجراءات الجزائية ومنحها المشروعية لاستنادها لأساس الشريعة ومصدرها الأول. Abstract : This research aims to establish the penal procedures in the Holy Qur’an, and aims to show how scholars understood their significance for these procedures. It has been found through the research that the verses that command justice are among the most important foundations of many procedures, and it has been showd that other verses had confirmed the necessity of confirmation before the ruling by trusted judges and investigators, who approved investigation procedures and requirements such as: writing records, approving experience and criminal inspection, and pointed out the need to classify the accused, imprison them, and the permissibility of the trick to reach the truth. And in order to achive that Controls and conditions have been established such as: the legality of the evidence and its severity, and the plaintiff bore the burden of proof, and approved the function of the Public Prosecution. Then some of the certification procedures are detailed and some of its conditions, and approved the oath of the witness, and then established to rely on evidence from the case and the subsequent knowledge of the judge and his intellect. In a way that confirms the Qur’an’s interest in the criminal procedures and granting them legitimacy, as It is based on the foundation of Sharia and its first source
