حقيقة حكاية الخلاف عن الأئمة في حكم الحديث المرسل

الملخص
يبحث عن أصل الخلاف المحكي عن أئمة المذاهب الفقهية في حكم الحديث المرسل, بالنظر إلى أقوالهم, وتطبيقاتهم العملية, وبالنظر في أول من حكى هذا الخلاف, وما سبب حكايته للخلاف, وهل وقع هذا الخلاف فعلا, أو له وجه آخر لم يفهمه هذا الذي حكى الخلاف, وهل إن حصل الخلاف هل هو خلاف حقيقي أو خلاف صوري لا ثمرة له, وبالاستقراء لعملهم وقولهم يتحقق الواقع في حكمهم على المرسل هل اختلفوا فيه, أو لم يختلفوا فيه. وظهر لي بالتتبع التاريخي لحكاية الخلاف أنه غير دقيق, وأن ما يفهم منه الخلاف ليس خلافا جوهريا, بل خلافا ليس راجعا لحقيقة الإرسال, بل لحقيقة المتن نفسه, وما يتعلق به من مقتضيات وموانع. This study researches the origin of dispute about Hadith Mursal among the scholars of Islamic jurisprudent by looking into what they said about it, their practices with regard to such type of Hadith, the first to narrate this dispute, the reason for dispute narration, did this dispute actually happened or it was a misunderstanding or misinterptretation of what the scholars said? giving that the dispute happened, was it an absolute dispute or an imaginary dispute which has no benefits. By thoroughly looking at what the scholars said and their practices, we can draw a conclusion about the reality of whether this dispute actually happened or not. After tracing the historical background of the dispute, I found out that the dispute wasn't real dispute in essence but the accuracy of what had been narrated and what it implies.
