الحقوق الزوجية غير المالية من نصوص قانون الأسرة الجزائري

الملخص
ملخص: يرتبط الزواج كغيره من العقود الأخرى بجملة من الاشتراطات التي يلزم بها أحد الطرفين الآخر بغرض دوام الزواج للأبد، وهي حقوق تبادلية؛ يبدي منها الزوج ما توافقه عليه الزوجة، كما تبدي الزوجة ما يوافقها عليه الزوج. ومهما يكن لهذه الاشتراطات من نتائج، ضمانا لاستمرار الزواج واستقراره، إلا أنها لا تحقق -وفي الكثير من الأحيان- المرغوب، ولذا يتدخل النص لضمان مجموعة من الحقوق الزوجية المادية منها والمعنوية، ولو كان للمادية دور مهم في تحقيق ظروف المعيشة الحسنة واستمرار الحياة الزوجية كما يثبته الواقع المعيش، إلا أن التي يُقام عليها استقرار الزواج وتجسيد معانيه الأساسية: كالمودة بين الطرفين والتراحم بينهما والسكنى لكليهما، هي الحقوق غير المالية، وبصفة أدق حقّ، معاشرة الزوج لزوجته بالمعروف ورعايته لها، وحق طاعة الزوجة لزوجها واحترامه له، وكل ما يترتب عليها من شروط فرعية تفصيلية. Abstract : Marriage, like other contracts, is bound to a set of requirements that either party compel the other party to them in order to perpetuate the marriage and that constitute reciprocal rights of which the husband and wife agree upon. Irrespective of the outcome of these requirements on the continuity and stability of marriage, they do not - often – achieve desired. Thus, the law provided provisions to ensure a set of material and moral marital rights. Although material rights, according to reality, plays an important role in achieving good living conditions and the continuity of marriage, the stability of marriage is based on the moral rights of affection, compassion and serenity between the two partners; particularly, the right of the wife to be well regarded by her husband as well as his right for obedience and respect from his wife and sub-conditions thereof.
