عدم فعالية الرقابة الإدارية الخارجية على الصفقات العمومية - قراءة في إطار أحكام المرسوم الرئاسي 15-247 -

الملخص
تحضى الصفقات العمومية أهمية خاصة في اقتصاد أي دولة فهي أداة لإنجاز المشاريع وتحقيق الخدمات، وإذا كانت الصفقة العمومية محل إنفاق للمال العام فهي من المجالات الخصبة لإهداره، الأمر الذي استوجب اخضاعها للرقابة وهذا ما حرص عليه المشرع منذ أول تنظيم للصفقات العمومية إلى غاية اصداره لأحكام المرسوم الرئاسي رقم 15-247 إذ أخذت الرقابة اهتماما بالغاً من المشرع، بإخضاع الصفقة العمومية لأطر رقابية متعددة خوفًا من انتهاك قواعد وإجراءات إبرامهاوترشيداً للإنفاق العمومي وبذلك تتنوع أوجه الرقابة على الصفقات العمومية بين رقابة إدارية وأخرى مالية وحتى قضائية، غير أن الغاية من هذه الدراسة الوقوف عند أحكام الرقابة الإدارية الخارجية باستعراض نقائصها وسلبياتها وإشكالاتها القانونية والتطبيقية التي حالت دون تحقيق الغاية من وجودها الأمر الذي أدى إلى الحكم بعدم فعاليتها. Abstract : Public transactions are of particular importance in the economy of any country, as they are a tool for the realization of projects and the realization of services. Presidential No. 15-247, so much the supervision aroused great interest of the legislator, by subjecting the public to face multiple control frameworks for fear of violating the rules and procedures of its conclusion and of rationalizing public expenditure. aspects of public procurement control vary between administrative and financial control and even judicial control, but the aim of this study is to stick to the provisions of external administrative control by examining their shortcomings, their negative points and the legal and practical problems which have prevented the achievement of the purpose of their existence, which led to the judgment of their ineffectiveness.
