الملخص
ملخص: تطبيقا لمبدأ الحرية التعاقدية يجوز للمتعاقدين أن يضمنا تعاقدهما أي شرط طالما أن هذا الشرط غير ممنوع قانونا، إلا أنه في ظل التطور في مجال التكنولوجيا والمعلومات، وفي ظل الممارسات الاحتكارية في ظل الاقتصاد الحر، انتشرت العقود النموذجية حيث ينفرد العون الاقتصادي بصياغتها بعيدا عن الرقابة، فيقوم بوضع شروط تعسفية مجحفة لتحقيق مصالحه، غير مهتم بالأضرار التي قد تقع على الطرف الآخر، مما استوجب وضع آليات تؤدي إلى توفير حد أدنى من الحماية للمستهلكين في الفترة التي تسبق التعاقد عبر الانترنت، ومن بين هذه الآليات حقه في مكافحة الشروط التعسفية. Abstract: Applying the principle of contractual freedom, the contracting parties may include any condition in their contract as long as it is not legally prohibited, except that in light of the development in the field of technology and information, and with the monopolistic practices under the light of a free economy, model contracts have spread where the economic agent exclusively formulates it away from any supervision, setting arbitrary unfair conditions to achieve his own interests, without caring whatsoever about the damages that may occur on the other party, which necessitated the establishment of mechanisms that lead to providing a minimum level of protection for consumers in the period right before contracting via the Internet, and among these mechanisms falls the right to combat arbitrary condition
