الفتـــــــــــــــــــوى الشــــــــــاذة: تعـــــــــــريفها ومعــــــــاييرها

الملخص
ملخص البحث بدأ البحث بمقدمة تحتوي على مدخل وإشكالية الدراسة, و الدراسات السابقة, وبيان أهمية الموضوع, والمنهج المتبع, وخطة البحث. ثم عالجت الموضوع في أربعة مطالب: عرفت بداية بالفتوى الشاذة في اللغة وفي الاصطلاح, واخترت تعريفا أنها: التفرد بقول مخالف للسواد الأعظم من المجتهدين بلا مستند من سماع أو قياس أو حجة معتبرة. أما المطلب الموالي فقد عرضت فيه لجملة من المعايير لشذوذ الفتوى كأن تخالف النص أو المقاصد أو تغير الحال. وفي مطلب ثالث درست شذوذ الفتوى لمخالفتها الإجماع والقياس. أما آخر المطالب فخصصته للشذوذ الناتج عن سوء فهم الواقع أو الاستدلال عليه. وأنهيت الموضوع بخاتمة سجلت فيها خلاصة البحث ونتائجه. Research Summary The research started with an introduction that includes the entrance and the problematic of the study, the previous studies, and the importance of the subject, the methodology, and the research plan. Then dealt with the subject in four demands: known at the beginning of the anomalous fatwa in the language and in the term, and chose a definition that: singularity contrary to the vast majority of the hard - working without a document of hearing or measurement or argument considered. The following demand was presented in which a set of criteria for the abnormality of the fatwa, such as contrary to the text or purposes or change the situation. In a third demand examined the abnormality of the fatwa for violating consensus and measurement. The latest demands are devoted to anomalies resulting from misunderstanding or inferring reality. I finished the topic Conclusion recorded the summary of the research and its results.
