تشريع السياحة الشاطئية وتحقيق التنمية المستدامة في الجزائر

الملخص
ملخص: تتجه الكثير من الدول اليوم إلى الاهتمام بالسياحة لا سيما الشاطئية منها، لكونها اهتماما بشواطئ البحر وحماية لها وانتفاعا بما تُدِرُّه من مداخيل وما تحققه من ثروة في إطار تنويع المداخيل والاهتمام بالثروة التي تزخر بها تك الدول، ولاعتبارها عامل أساسي لرفع النمو الاقتصادي وتشغيل الايادي العاملة وتحديث البنية التحتية وتحقيق الرضاء العام. وقد سار المشرع الجزائري على هذا النهج مواكبة منه لهذا الاهتمام حيث كان لزاما عليه أن يتدخل لوضع قواعد تهتم بإنشاء فضاءات سياحية على الشواطئ والمسطحات المائية وخلق أماكن للترفيه توفر الخدمات لمرتاديها، كما تنهض تلك القواعد القانونية بتشريع الحماية لتلك المنشآت وحماية المياه من التلوث والرمال والغابات المجاورة وغيرها، وبردع المخالفين عن طريق عقوبات جزائية بواسطة نصوص القانون 03/01 المتعلق بالتنمية المستدامة للسياحة والقانون 03/02 المتعلق بالقواعد العامة للاستعمال والاستغلال السياحيين للشواطئ، والقانون 03/10 المتعلق بحماية البيئة في إطار التنمية المستدامة. Abstract: Many countries today tend to pay attention to the tourism especially the beach ones, because they are interested in and protect the sea beaches and benefit from the income they provide and the wealth they achieve, and their status as a key factor for raising economic growth, employing manpower, modernizing infrastructure and achieving public satisfaction. The Algerian legislator followed this approach to keep pace with this interest, as he had to intervene to set rules concerned with establishing tourist spaces on beaches and water bodies, and creating places for entertainment that provide services to their visitors, and these legal rules promote the protection legislation for these facilities and the protection of water from pollution and sand and adjacent forests, and to deter violators through penal sanctions by means of the provisions of Law 01/03 relating to the sustainable development of tourism, Law 02/03 relating to general rules for the use and exploitation of beaches by tourists, and Law 10/03 relating to the protection of the environment within the framework of sustainable development.
