الحماية الجزائية للرجل من التحرش الجنسي أثناء علاقات العمل.

الملخص
من المعتاد الحديث عن جرائم التحرش ضد المرأة وهو دأب الجمعيات النسوية وجمعيات حقوق الإنسان، ولكن الحدوث عن التحرش الجنسي بالرجال فهو من الطابوهات التي ينبغي رفع الغطاء عنها ودراستها بأكثر واقعية وجدية في زمن طغى فيه العنصر النسوي في أغلب قطاعات الحياة، وينبغي توجيه الدراسات لهذا الفضاء من البحوث، ويتعلق الأمر بتحرش من نوع خاص ضحيته الرجال في مواقع العمل، وهو الأمر الذي يعتبر مستهجنا وغريبا، ولكن الواقع يثبت وبإحصائيات وحسابات هامة على تعرض الرجال للتحرش الجنسي والمساومة في علاقات العمل، وهو الأمر الذي ينبغي معالجته والتعاطي معه بكل جدية لما له من آثار نفسية وجسدية على حياة الرجل العامل، وربما عامل المشرع النساء كما الرجال في خطابه للمجتمع بالنصوص القانونية إلا أن الموضوع ذو خصوصية وذو أبعاد متشابكة ومعقدة، ربما يرجع الأمر أساسا لكون أغلب الرجال لا يرفضون تحرش النساء بهم، وأن الرجل يشعر بنشوة ذكورية زائفة عندما يتعرض للتحرش، وغالبا ما يستجيب، في حين أن غالبية النساء غالبا ما يقاومن ذلك. في الأغلب فهو تحرّش متبادل استغلالا للنفوذ وتغذية لنزوات عابرة، من ناحية أخرى فإن إحجام الكثير ممن وقع عليهم التحرش يمتنعون عن إبلاغ الجهات المسؤولة حرصا على سمعتهم ساعد هذا في تصعيب المشكلة، وأيضا في ضياع الدليل على هذه الواقعة وإفلات الجاني من العقاب نظرا لعدم إثبات جريمته، فقد أثبتت إحدى الدراسات بأن 2 ٪ فقط من الضحايا المعتدى عليهم يلجأن إلى الشرطة عند تعرضهم للتحرش بحيث تبقى جريمة التحرش ضمن الجرائم ذات الأرقام والإحصائيات المجهولة. Abstract: It is customary to talk about crimes of harassment against women, which is the persistence of feminist and human rights societies, but the occurrence of sexual harassment of men is one of the taboos that should be lifted and studied in a more realistic and serious manner at a time when the female component is prevalent in most sectors of life, and studies should be directed to this space From research, the issue is related to harassment of a special kind that men have victimized in the workplace, which is considered reprehensible and strange, but the reality proves, with statistics and important accounts, that men are exposed to sexual harassment and bargaining in work relationships, which should be addressed and seriously dealt with because of its Psychological and physical effects on the life of the working man, and the legislator may have treated women as well as men in his speech to the society with legal texts, but the topic is specific and has complex and interwoven dimensions, perhaps due mainly to the fact that most men do not refuse to be harassed by women, and that the man feels a false male orgasm when exposed To harassment, and it often responds, while the majority of women often resist it.
