الملخص
ملخص: تعد مسألة السيادة الشعبية باعتبارها فكرة فلسفية قديمة و متجددة في الآن ذاته، مسلكا هاما في ترسيخ مسار الديمقراطية في أي كيان أو دولة مستقلة. و قد تبنت عديد الدساتير الديمقراطيات المعاصرة، فكرة السيادة الشعبية كمنطلق يعبر عن جوهر تحقيق الإرادة الشعبية و يمنح السلطة أو النظام في الدولة الشرعية التي تعكس وتجسد مبادئ قيام دولة القانون، ومن هذا المنطلق فقد كرس النظام الدستوري الجزائري بدوره لمبدأ السيادة الشعبية لأهميته عبر كامل الدساتير التي تم تقريرها، معترفا للشعب بحقه في السيادة التي يمارسها وفق آليات متعددة، و من هنا يبرز هدف هذه الدراسة التي تسعى إلى تحديد مفهوم السيادة الشعبية كمبدأ دستوري و كذا آليات تطبيقها عمليا بما يحقق أهم متطلبات دولة الحق والقانون. الكلمات المفتاحية: مبدأ السيادة الشعبية، التشريع الجزائري، آليات ممارسة السيادة الشعبية، الضمانات، الرقابة الشعبية. abstract : The question of popular sovereignty as an old philosophical idea and renewed at the same time. An important way to consolidate the course of democracy in the independent state. Many constitutions, in contemporary democracies, have adopted the idea of popular sovereignty as a starting point which expresses the essence of the realization of the popular will and confers authority or order in a legitimate state which reflects and embodies the principles of the creation of the state of law, From this standpoint, the Algerian constitutional system, in turn, has devoted the principle of popular sovereignty to its importance through all the constitutions that have been decided, recognizing to the people their right to sovereignty that they exercise according to various mechanisms, and from here emerges the target of this study that seeks to define the concept of popular sovereignty as a constitutional principle as well as the mechanisms for its application practically to achieve the most important requirements of the state of right and law.
