الملخص

الملخص: من أهم الآثار التي تترتب على قيام الرابطة الزوجية، هي مسألة النفقة الزوجية، وفي الأصل أن واجب الإنفاق يقع على عاتق الزوج تجاه زوجته فهو ملزم بالإنفاق عليها وتوفير جميع متطلباتها، إلا أن هناك بعض الإستثناءات التي قد تطرأ على الحياة الزوجية، والتي تسقط واجب النفقة على الزوج، وتجعل الزوجة ملزمة بالإنفاق على بيتها، وهذه الإستثناءات تحدثت عنها الشريعة الإسلامية كما تبنتها مختلف التشريعات العربية، ومع أن الشريعة الإسلامية قد أقرت مبدأ الإستقلال الذمة المالية بين الزوجين، أي أن للزوجة ذمة مالية خاصة بها ومستقلة تماما عن زوجها، إلا أن الزوجة العاملة أصبحت مطالبة بالمساهمة في الإنفاق على بيتها لتعويض النقص الذي يشوب إلتزاماتها تجاه زوجها وأولادها بسبب عملها، وهذا نتيجة لإعتماد العديد من القوانين الأسرية العربية لمبدأ المساواة بين الزوجين. الكلمات المفتاحية: إلتزام الزوجة، الإنفاق، الذمة المالية، إشتراك، نفقة. Abstract: One of the most important effects of the establishment of the marital bond is the issue of spousal maintenance, and in principle, the duty of maintenance falls on the husband's shoulders towards his wife, as he is obligated to spend on her and provide all her requirements, However, there are some exceptions that may occur to marital life, which drop the obligation of maintenance on the husband, and make the wife obliged to spend on her home, and these exceptions are mentioned by Islamic law as adopted by various Arab legislations, Although Islamic law has approved the principle of financial independence between the two spouses, meaning that the wife has a financial responsibility of her own and is completely independent of her husband, the working wife has become required to contribute to spending on her home to compensate for the shortfall that marred her obligations towards her husband and children because of her work, and this is a result of the dependence Several Arab family laws for the principle of equality between spouses Keywords: wife's obligation, spending, financial liability, participation, alimony.
