الملخص
ملخص: أدى ظهور فكرة الحقوق الرقمية إلى ضرورة البحث في تأصيلها وتحديد مفهومها. وهذا ما تسعى إليه بعض أجهزة الأمم المتحدة حيث تواصل تأكيدها أن الحقوق التي يتمتع بها الأفراد خارج الأنترنت هي نفسها التي تحظى بالحماية على الأنترنت؛ وتخص بالذكر في الغالب بعض الحقوق كالحق في حرية الرأي والتعبير والحق في الخصوصية. بل إنّ النقاش أصبح يدور حول حق الإنسان في الأنترنت. تمّ التأكيد مرارًا على أن القواعد القانونية المتاحة في المواثيق الخاصة بحماية حقوق الإنسان كفيلة بحماية الحقوق الرقمية، إلا أنّ الممارسة أثبتت أنّ الدول تستغل فكرة إمكانية تقييد التمتع بالحقوق للضرورة لتقييد الحقوق الرقمية لدواعي مختلفة، ومع ذلك فإنّ بعضها يعمل على مواءمة تشريعاتها الداخلية مع المواثيق الدولية لضمان توفير الحماية لها.ولهذا سنحاول من خلال هذه الدراسة تحديد مفهوم الحقوق الرقمية، وبيان أصنافها، ومن ثمة نقوم بتحليل المواثيق الدولية والنصوص القانونية التي أقرت حمايتها، ونسلط الضوء على التحديات التي تواجهها. Abstract: The emergence of the idea of digital rights led to the necessity of researching its roots and defining its concept. This is exactly what some United Nations agencies seek, as they continue to affirm that the rights held by people offline must also be protected online, Often, some rights are singled out, such as the right to freedom of opinion and expression and the right to privacy which need special protection in the cyberspace. Moreover, the debate has become revolving around the human right to Internet access it has been repeatedly emphasized that The legal rules enshrined in human rights legal instruments guarantee also the protection of digital rights, However, practice has shown that states exploit the possibility of restricting the enjoyment of rights when necessary to restrict digital rights for various reasons, yet, some of them work on harmonizing their domestic legislation with international conventions to ensure protection of these rights. Therefore, we will try, through this study, to define the concept of digital rights, indicate their types, and from there we will analyze the international instruments and legal texts that have been approved to protect them, and highlight the challenges these rights face.
