المصنفات المشتركة في نظام الملكية الأدبية والفنية ( دراسة مقارنة )

الملخص
تعتبر المصنفات المشتركة التكييف المبدئي للمؤلفات التي ساهم في إنجازها عدة مؤلفين، وذلك نظرا للتعريف القانوني الواسع لهذا النوع من المصنفات. ويعد الإنتاج مشتركا إذا شارك في إنجازه أو إبداعه عدة مؤلفين، فالمصنفات المشتركة تتطلب مشاركة عدة أشخاص يهدفون إلى غرض موحد، ويجب أن تكون هذه المساهمة مباشرة في إنجاز العمل المحقق. وبالتالي٬ فالمصنف المشترك أو التعاوني يتكون من مجموعة مساهمات منجزة من طرف عدة مؤلفين عن طريق التعاون والتنسيق فيما بينهم رغم أن هذه المساهمات المتعددة قد تكون من نفس النوع أو ذات طبيعة مختلفة. كما أنه لا يمكن الكشف عن المصنفات المشتركة إلا وفقا للشروط المتفق عليها بين مختلف المؤلفين المساهمين . إن الأشخاص المشاركين في انجاز المصنف المشترك لديهم الحقوق المادية والمعنوية المنصوص عليها قانونا في مجمل المصنف المحقق٬ فهم أصحاب المصنف ولديهم الحق في استغلاله .Abstract: The collaborative works are considered the initial adaptation of the works that several authors have contributed to, given the broad legal definition of this type of works. Production is considered joint if several authors participate in its accomplishment or creativity, so joint works require the participation of several people aiming at a unified purpose, and this contribution must be directly in accomplishing the work achieved. Consequently, the joint or cooperative work consists of a set of contributions accomplished by several authors through cooperation and coordination among them, even though these multiple contributions may be of the same type or of a different nature. Also, joint works can only be disclosed according to the conditions agreed upon by the various contributing authors. The persons involved in the completion of the joint work have the material and moral rights legally set out in the whole of the work being investigated, they are the owners of the work and have the right to use it.
