النظام القانوني للمحكمة الدستورية في الجزائر (قراءة في أحكام التعديل الدستوري 2020)

الملخص
يرتبط وجود محكمة دستورية أو مجلس دستوري أساسا بمبدأ سمو الدستور والرقابة على دستورية القوانين، ومن هذا المنطلق تسعى الدول وهي تؤسس دساتيرها إلى انشاء مؤسسة محكمة الدقة لتمارس مهمة حماية الدستور والرقابة على دستورية القوانين قد تكون هذه الهيئة سياسية أو قضائية. ولقد عرف التعديل الدستوري الجزائري لسنة 2020 إنشاء مؤسسة دستورية جديدة تحت مسمى المحكمة الدستورية تختص بالرقابة على دستورية القوانين حلت محل المجلس الدستوري، وقد جاءت هذه المؤسسة ضمن سلسلة الاصلاحات الدستورية التي قامت بها الجزائر على مستوى العديد من المؤسسات من أجل إضفاء شرعية أكثر عليها وتفعيل مهامها واختصاصاتها. وسنتناول ضمن هذا المقال دراسة النظام القانوني لهذه المحكمة وذلك في إطار دراسة تحليلية للنصوص الدستورية المنظمة لها من خلال البحث في تكوينها واختصاصاتها وما الجديد الذي جاء به التعديل الدستوري 2020 فيما يخص سلطات المحكمة الدستورية مقارنة بالمجلس الدستوري. The existence of a constitutional court or constitutional council is mainly linked to the principle if the supremacy of the constitution and overseeing the constitutionality of laws ,and from this point of view, states, while establishing their constitutions, seek to establish and institution of precision court to exercise the task of protecting the constitution and overseeing the constitutionality of laws. The Algerian constitutional amendment for the year 2020 defined the establishment of a new constitutional institution under the name of the Constitutional Court, which has jurisdiction over the constitutionality of laws, which replaced the Constitutional Council. This institution came within a series of constitutional reforms undertaken by Algeria at the level of many institutions in order to give them more legitimacy and activate their functions and competencies. In this article, we will deal with thw study of the legal system of this court , within the framework of an analytical study of the constitutional texts regulating it, by examining its composition and terms of reference and what is new in the 2020 Constitutional Amendment regarding the power of the Constitutional Court compared to the Constitutional Council.
