خصوصية الحجز التحفظي على الأموال العقارية

الملخص
يهدف المشرع الجزائري من خلال إقرار توقيع الحجز التحفظي عامة، والحجز التحفظي على العقارات خاصة، إلى تحقيق حماية وقتية وسريعة للدائن في مواجهة مدينه مخافة تهريب هذا الأخير لأمواله، وإن كان تهريب الأموال المنقولة للمدين أمر منطقي ووارد جدا، فإنه يصعب تصور ذلك في الأموال العقارية بسبب طبيعتها الخاصة التي لا تسمح بنقل هذه الأموال من مكان لآخر دون تلف، غير أن ذلك ليس صحيحا من الناحية الواقعية، فإن استحال النقل المادي لهذه الأموال، فإن التهريب القانوني لها وارد جدا عن طريق البيع، أو الهبة إلى غيرها من التصرفات الناقلة للملكية. هذا ما جعل المشرع الجزائري يراجع هذه الأحكام ضمن آخر تعديل لقانون الاجراءات المدنية سنة 2008، أين أقر صراحة جواز توقيع الحجز التحفظي على الأموال العقارية مثلها في ذلك مثل المنقولة، غير أنه في المقابل لم يفرد لها أحكاما خاصة إلا ما جاءت به المادة 522 من قانون الإجراءات المدنية والإدارية دون أي تفصيل آخر. The Algerian legislator aims, by adopting the preventive seizure to provide a temporary and rapid protection of the debtor in order to face his creditor of fear of smuggling his funds, even if smuggling of chattels by the creditor is logic, this action may be difficult to conceive in the case of the immovable properties from one place to another without any damage, however, that’s not right, because when the material transport of the property is impossible, its legal smuggling can be quite possible through sale, donation or other legal transactions of transporting the property. So that, the legislator revised these provisions and recognized the permissibility of the preventive seizure on the immovable properties as well as the transferred properties, nevertheless, he didn’t devote it by particular provisions only those mentioned in the article 522 of the law of civil and administrative procedure without any other details.
