وظيفية مهام سلطات ضبط قطاعي المحروقات والمناجم في مجال حماية البيئة

الملخص
تعتبر سلطات الضبط القطاعية أسلوبا جديدا يعبر عن وظيفة الدولة الضابطة، نظرا لتمتعها بمهام تتضمن الرقابة والمتابعة والإشراف على الأنشطة القطاعية، حيث أحاطها المشرع الجزائري بنظام قانوني يسمح لها بممارسة اختصاصات عدة، لاسيما في مجال حماية البيئة، فبالنظر لما تواجهه البيئة من سلامة نتيجة الأنشطة الصناعية بصورة عامة، ومن أنشطة قطاعي المحروقات والمناجم بصورة خاصة فإن المشرع الجزائري أحاط سلطات الضبط القطاعية الخاصة بهما بنظام قانوني تضمن دورا يقتضي البحث في مضمونه من أجل تحديد مدى فاعليته في حماية البيئة من أنشطة القطاعين. ومن هذا المنطلق فإن هذه الدراسة تهدف إلى توضيح دور سلطات الضبط في كل من قطاعي المحروقات والمناجم في الجزائر، في حماية البيئة من أنشطة القطاعين، حيث أسفرت هذه الدراسة على نتائج عدة تبرز أهمها من خلال بيان تفصيل الصلاحيات المخولة لسلطات الضبط في حماية البيئة في قطاعي المحروقات والمناجم، إضافة إلى تقيمم مدى نجاعتها، وإبراز ووظيفيتها كأسلوب جديد لحماية البيئة من المخاطر التي تهدد سلامة البيئة the Independent authorities are considered a new method that expresses the function of the controlling state, given that it has tasks that include monitoring, follow-up and supervision of sectoral activities, as the Algerian legislature has surrounded it with a legal system that allows it to exercise several powers. Especially in the field of environmental protection, given the safety of the environment as a result of industrial activities in general, and the activities of the hydrocarbon and mining sectors in particular, the Algerian legislator has surrounded their sectoral control authorities with a legal system that includes a role that requires research into its content in order to determine its effectiveness in protecting the environment. From this standpoint, this study aims to clarify the role of the the Independentauthorities in each of the hydrocarbon and mining sectors in Algeria, in protecting the environment from the activities of the two sectors, And to evaluating their efficacy, to Clarification their function as a new way to protect the environment from threats to environmental safety.
