التجربة الدستورية الجزائرية ، وبناء الديمقراطية

الملخص
تتناول هذه الدراسة التجربة الدستورية في الجزائر (وضع الدساتير وتعديلها)، ودور ذلك في عملية بناء الديمقراطية فيها . لهذا السبب سيتم التطرق إلى تطور هذه التجربة الجزائرية لعملية وضع الدساتير وتعديلها منذ استقلال الجزائر إلى اليوم. ثم سنتناول الخصائص التي تميزت بها هذه التجربة الدستورية. وأخيرا سنقوم بدراسة تقييمية لهذه التجربة، لتبيان دورها في بناء الديمقراطية في الجزائر . ومن هنا تظهر أن هذه الدراسة ذات قيمة كبيرة ، لأنها تتناول موضوعا ذا أهمية قصوى ،إذ أن وضع الدساتير وتعديلها لعب ويلعب دورا أساسيا في بناء الديمقراطية في الدول التي خطت خطوات طويلة في هذا المجال . فماذا عن التجربة الدستورية الجزائرية ؟ ولكن الدراسة تصل إلى نتيجة أن التجربة الدستورية في الجزائر، للأسف ،لم تلعب دورا أساسيا في بناء الديمقراطية، وذلك نتيجة لمجموعة من الأسباب والإعتبارات سيتم تبيانها ، والتي إن تم تجاوزها يمكن لهذه التجربة الدستورية الجزائرية أن تحقق الأهداف المرجوة ، أي بناء ديمقراطية صحيحة . This study is analysing the Algerian constitutional experience (issuing constitutions & amending them), & the role of this in the process of building democracy . For this reason the study is treating the stages that this experience has witnessed. It also is looking at the characteristics of this experience . & finally,the study is making an evaluating analysis of the Algerian constitutional experience in order to demonsrate the role of this experience inthe building of democracy in Algeria . The study is important ,& that arises from the fact that it is treating a very significant subject , because issuing constitutions & amending them have played an important role in the process of building democracy in those countries that have leading experiences in this matter. So what about the Algerian constitutional experience ? But unfortunately the study reaches a result that the Algerian constitutional experience , has not played a perfect role in the building of democracy, due to several reasons & considerations , which if they are to be overcome , the desired objectives can be well achieved .
