العقارات غير المطالب بها بين جديد النصوص التنظيمية والنصوص التشريعية

الملخص
لقد شهدت مرحلة الانتقال التدريجي من نظام الشهر الشخصي إلى نظام الشهر العيني عدة معوقات ترجع أساسا إلى المنازعات الناتجة عن مباشرة أشغال مسح الأراضي ، ويتعلق الأمر بالتسجيل المؤقت للأملاك في حساب العقارات غير المطالب بها ، نتيجة غياب المالك أثناء إجراء المسح و/ أو تقصير فرق المسح في إشعار ها بالمرور .. تمهيدا لإعادة تسجيلها في حساب الدولة وبهدف تسريع عملية المسح الشامل لأراضي الجمهورية التي انطلقت فعليا سنة 1993 أصدرت المديرية العامة لأملاك الوطنية بدئ من سنة 1998 العديد من النصوص التنظيمية لمعالجة هذا النوع من المنازعات في ظل فراغ قانوني دام أكثر من 39 سنة توج بصدور قانون 14/10 المتضمن ق المالية لسنة 2015 و قانون 17/11 المتضمن ق المالية لسنة 2018 . The matter is related to the temporary registration of estates in the unclaimed real estate accounts, as a result of the owner’s absence during the survey and / or the survey teams ’failure to notify them of passage… in preparation for re-registering them in the state’s account. With the objective of speeding up the comprehensive survey operation of the republic’s lands that was actually launched in 1993, the General Directorate of National Property in 1998, issued many regulatory texts deal with this type of dispute in legal under vacuum lasted more than 39 years that culminated in the issuance of the Law 10/14 containing the financial law for the year 2015 and Law 11/17 containing financial law for the year 2018.to
