الملخص
ملخص: يعد تحرير حركة رؤوس الأموال أساس الحياة الإقتصادية في أي بلد، وذلك من خلال مساهمته في تحقيق التنمية الإقتصادية باعتباره حجر الأساس لتسير الاستثمارات وازدهارها ، ولقد شهد تكريس مبدأ تحويل رؤوس الأموال في إطار الإستثمار الأجنبي اهتماما واسعا في جل تشريعات الدول . وطالما أن الجزائر ومنذ استقلالها وهي تبحث عن أهم المقومات للخروج من حالة التأخر التي وصلت إليها، والنهوض باقتصادها ورفع قدراتها الانتاجية ، فقد رأت أنه من الضروري اللجوء إلى الاستثمارات الأجنبية لما توفره من رأس مال وخبرة علمية وتقنية ، خاصة بعد الإصلاحات التي قامت بها الجزائر عقب الآزمة المالية التي شهدتها في الثمانينات . و من هنا بدأ المشرع يولي اهتماما أكثر لتكريس حرية التحويل في مجال الاستثمار الأجنبي ، خاصة وأن المستثمر يعلق أهمية بالغة على صياغة هذا المبدأ ضمن قانون الاستثمار ، ذلك أن تحقيق الأرباح داخل الدولة المضيفة ليس همه الشاغل بقدر حرصه على حرية تحويلها مستقبلا إلى الخارج. Abstract: The liberalization of the movement of capital is the basis of the economic life of any country, by its contribution to economic development as a cornerstone of the flow of investments and their prosperity, and the principle of the transfer of capital within the framework of investment foreigner has aroused widespread interest in the legislation of most countries. As long as Algeria, since its independence, seeks the most important ingredients to emerge from the backward state that it has reached, and to boost its economy and increase its production capacities, it felt that it was necessary to resort to foreign investments because of the capital and the scientific and technical expertise that it brings, in particular after the reforms that Algeria made after the financial crisis of the 80s. Therefore, the legislator began to pay more attention to enshrining the freedom of transfer in the field of foreign investment, especially since the investor attaches great importance to the formulation of this principle in the Law on investment, because making profits inside the host country is not as much of a concern as its concern for the freedom to transfer abroad in the future.
