الملخص
تعتبر الملكية العقارية أهم وجهة تم استغلالها في مجال الاستثمار وفق منظومة تشريعية معقدة ومتناثرة ومتعددة ضمن تعديلات لا نهاية لها في توجيه الاوعية العقارية للاستثمار ضمن ما يعرف بالعقار الاستثماري الذي ينظر إليه من جانب العقار نفسه محل الاستثمار الصناعي او السياحي او الفلاحي او الوقفي او حضيرة تكنولوجية ، الذي تم تنظيمه من خلال الأمر 08-04 المؤرخ في 01/09/2008 المحدد لشروط وكيفيات منح الإمتياز على الأراضي التابعة للأملاك الخاصة للدولة والموجهة لإنجاز مشاريع استثمارية المعدل والمتمم ، ومن جهه الملكية العقاري باعتبارها حق عيني ضمن نوعية طرق الاستغلال للعقار في مجال الاستثمار ضمن عقد الامتياز العقاري الذي اختلف طرقه بين التراضي والتنازل، ونظرا لعدم استقرار المنظومة التشريعية في مجال العقاري الاستثماري نظرا للتعديلات المتلاحقة في قوانين المالية إدى إلى عدم تشيجع الاستثمار في هذا المجال وفشل المشاريع الاستثمارية نظر لعدم تحقيق الامن القانوني في مجال العقار الاستثماري .
