العولمة وتأثيرها على الجريمة والعقاب

الملخص
لقد نتج عن العولمة مساحة واسعة من المرونة وحرية انتقال الأشخاص والأموال، مما أدى إلى امتداد أثرها واستغلالها من قبل المجرمين، حيث توسع نطاق الإجرام باستحداث أساليب وتقنيات الاتصال لارتكاب الجريمة، وعليه تبين قصور التشريعات الوطنية في مكافحة الجريمة، ولما كانت التشريعات الجزائية الوطنية عاجزة عن مكافحة الجريمة المستحدثة، فمن الأهمية بمكان عقد اتفاقيات ثنائية مع الدول، والأخذ بتنظيم أمني وقضائي لإيجاد سبل ناجعة وآليات مكافحة عالمية وضبط تقنيات نقل المحكوم عليهم لتنفيذ العقوبات، وتحديد أساليب التحقيق وأدلة الإثبات بين الدول، أما الإشكالات التي أصبحت تثار حول كيفية الحد من الجريمة في ظل العولمة التي أصبحت تقنياتها متطورة تكنولوجيا والتي قد تطمس معالم الجريمة وبالتالي ينعدم النص لتجريمها. Abstract : Globalization has resulted in a wide area of flexibility and freedom of movement of people and funds, which has led to the extension of its impact and exploitation by criminals, as the scope of crime has expanded through the development of methods and techniques of communication for the commission of crime, and therefore it is evident that national legislation has failed to combat crime, and since national penal legislation has been unable to Combating the created crime, it is extremely important to conclude bilateral agreements with countries, to adopt a security and judicial organization to find effective ways and global control mechanisms, to control transfer techniques for the convicts to implement penalties, and to define methods of investigation and evidence between countries, as for problems That has been raised about how to reduce crime in light of globalization, whose technologies have become technologically advanced and that may obscure the features of crime and thus the text is lacking to criminalize it.
