فعالية الوساطة في المواد الجزائية

الملخص
ملخص: إن الناظر من فوق كل بقعة من أرجاء هذا العالم كله و لمدة دقائق يرعبه مشهد ما يرى ، في كل دقيقة جريمة و في كل مكان معركة بطلها الإنسان و ضحيتها الإنسان ، هذه الظاهرة أنهكت كاهل القضاء و حيرت عقول الباحثين و رجالات القانون مما أنهض هممهم بالتفكير في التعامل مع مواقف النزاع . إن الأساليب التقليدية باتت غير فعالة في إنهاء النزاعات، أو على الأقل التقليل منها الأمر الذي دفع بالمشرع الجزائري إلى تغيير استراتيجيته لمكافحة الجريمة و تحويل السلوكات السلبية الهدامة إلى سلوكات ايجابية بناءة ، والتخفيف من عدد القضايا التي تصل إلى القضاء .إن تحقيق هذه الأهداف يبدأ بالتعامل مع مواقف النزاع، و في هذا الصدد إستحدث المشرع الجزائري نظام الوساطة في المواد الجزائية كخيار ودي للتعامل بشكل ايجابي و بناء مع مواقف النزاع كبديل عن تحريك الدعوى العمومية. في هذه الورقة البحثية أردت أن أسلط الضوء على نظام الوساطة الجزائية و مدى فعاليتها في كبح جماح السالكين درب الجريمة ،و تصحيح الاعوجاج في السلوكات و نشر السلم الاجتماعي. Abstract: The one who looks over every corner of the whole world and for a period of minutes isterrified by the sight of whathesees, every minute is a crime and in every place a battlewhere the humanhero and the humanvictim are, thisphenomenonexhausted the shoulders of the judiciary and baffled the minds of researchers and men of law, whichraisedtheir motivation to think In dealingwithconflict situations. The traditionalmethods have become ineffective in endingconflicts, or at least reducingthem, whichprompted the Algerian legislator to change itsstrategy to combat crime and convertnegative destructive behaviorsinto positive, constructive behaviors, and reduce the number of cases thatreach the judiciary. Achievingthese goals beginswithdealingwithconflict situations, and in this regard, the Algerian legislator has introduced a system of mediation in penalmatters as a friendly option to deal positively and constructivelywithconflict situations as an alternative to initiating a public case. In thisresearchpaper, I wanted to shed light on the penalmediation system and itseffectiveness in restraining the paths of crime, correcting the distortions in behavior and spreading social peace
