معالم التسيير الديمقراطي في نظام المجالس الشعبية البلدية بالجزائر

الملخص

تعتبر المجالس الشعبية البلدية نموذجا فريدا في مجال تسيير الشأن المحلي، وذلك على اعتبار قربها وصلتها المباشرة بالمواطن ونظرا لطبيعة المصالح المنوطة بإدارتها أو تسييرها، حيث يتميز هذا النوع من التسيير بالجماعية، ويبرز ذلك من خلال نظام سير المجلس عبر دوراته، وكذا المداولات التي تعتبر العنصر الرئيسي أو الآلية الأكثر بروزا في تسيير الشأن المحلي، وكذلك نظام اللجان، وذلك حتى لا يترك المجال للانفراد والاستئثار بالقرار في يد شخص واحد؛ كما أنها هناك آليات أخرى كرسها المشرع بتبنيه لفكرة الديمقراطية التشاركية لتعزيز الثقة بين المواطن والمنتخب المحلي، ولتعميق الديمقراطية أكثر، وذلك بعد ثبوت قصور الديمقراطية التمثيلية. Abstract: Municipal people's councils are considered a unique model in the field of running local affairs, considering their proximity and direct link to the citizen and due to the nature of the interests entrusted with managing or managing them, as this type of management is distinguished by the collectivity, and this is evident through the system of the council’s functioning through its sessions and such the deliberations, which are considered the main element or the most prominent mechanism in the conduct of local affairs, as well as the committee system, in order not to leave room for individualism and the monopolization of the decision in the hands of one person, and there are other mechanisms devoted by the legislator by adopting the idea of participatory democracy to enhance confidence between the citizen and the local team and to deepen democracy.
