ترجمة العبارات المسكوكة في عقود الإيجار

الملخص
تتميز لغة القانون عن غيرها من لغات التخصص بجملة من الخصائص التركيبية والمعجمية والدلالية التي تزيدها تعقيدا وصعوبة وتجعل ترجمتها كذلك من أصعب أنواع الترجمة المتخصصة. ولعل أبرز هذه الخصائص والتي تشكل ترجمتها تحديا حقيقيا للمترجم هي العبارات المسكوكة، مثل: بموجب هذا العقد، أنا الموقع أدناه، اتفق الطرفان على...، وغيرها الكثير من العبارات الراسخة في تقاليد الصياغة القانونية والتي تشكل تحديا بالنسبة للمترجم. يهدف هذا المقال إلى تسليط الضوء على العبارات المسكوكة في لغة القانون وترجمتها. حيث سنقوم بداية بالتطرق إلى مفهوم العبارات المسكوكة وأصنافها التي اقترحها أهم الباحثين في هذا المجال بالإضافة إلى تقنيات ترجمتها، ثم سنجري دراسة تحليلية مقارنة لعينة من العبارات المسكوكة مأخوذة من ثلاثة ترجمات رسمية لعقد إيجار تجاري. The language of law is distinguished from other types of specialized languages by a set of syntactic, lexical, and semantic characteristics that increase its complexity and difficulty, making it the most difficult type of specialized translations. Set phrases, such as: hereby, I, the undersigned, the parties have agreed upon…, and many other expressions established in legal drafting traditions, are perhaps the most prominent of these features, and whose translation poses a serious challenge to the translator. This article aims to shed light on set phrases in legal language and their translation. First, we will discuss the concept of set phrases and its different classifications and translation methods proposed by the most influential researchers in this field, then, we will conduct an analytical comparative study of a sample of set phrases extracted from three official translations of a commercial lease agreement.
