تأثير التدابير الوقائيى الناتجة عن كوفيد 19 على عقود الايجار

الملخص
ملخص: إن التدابير الوقائية المتخذة من قبل الدولة بسبب كوفيد 19 أثرت على المستأجر لالتزامه بدفع الأجرة نظرا لنقص الانتفاع بالعين المؤجرة أو انعدامه، بسبب تقييد حركة المواطنين ومنع الأنشطة التجارية. ولان العدالة العقدية تقتضي ألا يتحمل المستأجر وحده تبعة هده التدابير، لاعتبارها سببا أجنبيا عن العقد تتغير طبعته بحسب أثره على التزامات المستأجر . فإن أدت هده التدابير إلى استحالة دفع المستأجر للأجرة اعتبرت قوة قاهرة وترتب عليها انفساخ العقد وتحمل المستأجر تبعة الهلاك، وإن أدت إلى إرهاق المستأجر في دفع الأجرة فيمكنه المطالبة بإنقاص الأجرة أو الفسخ باعتبارها طرفا طارئا . abstract: The measures taken by the state, in relation to Covid 19, have generally influenced tenants. The latter are committed to pay their rents despite the fact that their benefits are notably insignificant if not absent owing to the state’s restrictions on both individuals’ circulation and commercial activities. Additionally, justice, mainly concerned with contracts, requires that tenants should not bear the repercussions of these measures alone. These measures are not part of the contract whose terms should be changed as far as its effect upon the tenants’ commitments. Losses would be therefore handled by the tenant. If they caused damages to the tenant, it would be possible to ask for a decrease in renting or an annulment of the contract as it is an emergency.
